NEW YORK (Reuters) - U.S. stocks were little changed on Monday, pausing after a rally that pushed the Dow and S&P 500 to record highs last week on improving earnings and reassuring signs about the economy.

Apple shares were among the top gainers, up 2 percent at $458.65 and giving the biggest boosts to the Nasdaq composite index and benchmark S&P.

Market watchers said there is more room for stocks to rise as investors use weakness in the market as an opportunity to add to positions.

"There were some negative sentiment heading into earnings and concerns about the spring slowdown or 'sell in May and go away,'" said Todd Salamone, director of research at Schaeffer's Investment Research in Cincinnati, Ohio.

"Also economic numbers were weak. We don't see that now. We've hit this sweet spot in economic data where numbers are better-than-expected. But on an absolute basis, they won't make the Fed unwind their support for stimulus."

Although weak economic data from the euro zone and China has caused concerns over the global growth outlook, Friday's stronger-than-expected U.S. payrolls report fueled the gains that took the indexes to record levels.

Equities have been strong so far this year, with the S&P 500 up more than 13 percent in 2013 on the back of strong corporate earnings and accommodating monetary policies that have kept interest rates low.

The Dow Jones industrial average was down 26.54 points, or 0.18 percent, at 14,947.42. The Standard & Poor's 500 Index was up 0.46 point, or 0.03 percent, at 1,614.88. The Nasdaq Composite Index was up 6.21 points, or 0.18 percent, at 3,384.85.

A number of bellwether names rallied on Monday, with Bank of America Corp up 2.3 percent to $12.52 and Apple Inc up 1.7 percent to $457.58. Humana Inc jumped 3.4 percent to $76.45 as the S&P 500's biggest percentage gainer. JPMorgan upgraded the stock to "overweight."

But Johnson & Johnson shares were down more than 1 percent at $84.79, weighing on the blue-chip Dow average.

BMC Software Inc agreed to be acquired by a private equity group led by Bain Capital and Golden Gate Capital Corp for about $6.9 billion. Shares were up 0.2 percent to $45.50.

Tyson Foods Inc reported a steep drop in its second-quarter earnings, hurt as customers switched to chicken from beef to save money. The stock dropped 4.3 percent to $23.86, the biggest percentage decliner on the S&P 500.

Of the 404 companies in the S&P 500 that have reported earnings so far, 68.3 percent have beaten earnings expectations, according to Thomson Reuters data, though only 46.3 percent have reported revenue above expectations. Over the past four quarters, 67 percent of companies beat on earnings and 52 percent beat revenue estimates.

Warren Buffett said on Monday low interest rates have made bonds "terrible" investments, but stocks are "reasonably priced," and he continues to shy away from sectors such as media where he cannot predict which will thrive in the long run.

DUBAI (Reuters) - Few Iranian presidential elections have been so unpredictable but the next few days will at least narrow down who will stand in the ballot on June 14, for which candidate registration starts on Tuesday and ends on Saturday.

What is certain is that Ayatollah Ali Khamenei, who has held ultimate power as Supreme Leader for 24 years, wants to avoid both the mass protests by reformists that greeted the disputed re-election of Mahmoud Ahmadinejad in 2009, and also more of the public feuding between the outgoing president's allies and fellow hardliners which has marked Ahmadinejad's second term.

"The Iranian leadership is so nervous, even if it doesn't need to be. The 2009 election was an enormous loss of face for the establishment and they're very concerned about a repetition," said a Western diplomat based in Tehran.

"Instead of trusting the people, they have put their trust in all sorts of security measures.

Some hopefuls have already declared they will register to run in the first round in six weeks. But many with the strongest chances have been hanging back, weighing their prospects until the last minute, with an eye not only to public opinion but to the Guardian Council of clerics and jurists which can reject any candidacy until a final roster is published around May 23.

With reformist groups largely suppressed over the past four years, the election campaign may reflect little of the debates among Iranians - on how to shore up an economy sagging under Western sanctions, or on foreign policy and the nuclear program that has provoked international concern.

"There is an absence of political discussion, a lack of talk about taxation, the economy or relations with neighboring countries," the Tehran-based diplomat said.

AHMADINEJAD CAMP

Ahmadinejad, who cannot seek a third mandate, secured an outright win with 62 percent in the four-man first round in 2009, provoking claims of fraud and the biggest protests since the revolution that deposed the Shah in 1979. If no candidate secures more than 50 percent, the runoff will be a week later.

Although Ahmadinejad, 56, is barred by law from running again, his rivals among fellow hardliners committed to resisting a dilution of the state's Islamist founding principles fear the confrontational incumbent will back a candidate - possibly his close aide Esfandiar Rahim Mashaei - to preserve his influence, even in the face of disapproval from the 73-year-old Khamenei.

"Unlike the first generation of revolutionary elite who played by the rules, Ahmadinejad's group has consistently pushed against regime red lines and at times even challenged the authority of the Supreme Leader," said Yasmin Alem, a U.S.-based expert on Iran's electoral system.

"For them, ambition trumps allegiance to the regime's principles."

For his part, Khamenei is turning to a loyal alliance which includes his adviser Ali Akbar Velayati, another ally Gholam-Ali Haddad-Adel and charismatic Tehran mayor Mohammad Baqer Qalibaf, in the hope of securing a quick and painless election win, say analysts and diplomats.

But that informal coalition's final candidate has yet to be declared - a sign they are still sizing up the competition.

FORMER PRESIDENTS

Even less clear are the intentions of former presidents Akbar Hashemi Rafsanjani and Mohammad Khatami, whose moderate candidacies would radically alter the contest. Both appear reluctant to stand unless given the nod from Khamenei but neither have ruled themselves out.

"I will not enter the field without his consent," Rafsanjani said this week, according to the Mehr news agency. "If circumstances are such that there will be conflicts and disputes between me and the leader, we will all lose."

He was president from 1989 to 1997. Khatami, a reformist who succeeded Rafsanjani until 2005, retains much popularity, especially among secular middle classes, youth and women voters.

"Khatami is definitely the most loved," said a social media consultant in Tehran working for a reformist campaign. "Everyone is waiting for his response. The Qalibaf and Velayati staff are calling his office constantly to see if he will run."

Both Rafsanjani and Khatami have been sidelined since 2009 and their association with reformist leaders Mirhossein Mousavi and Mehdi Karoubi - losing candidates to Ahmadinejad in 2009 and under house arrest for more than two years - has attracted sharp criticism from hardliners.

Mainstream contenders are not the only ones facing pressure from the authorities. Hooshang Amirahmadi, an academic living in the United States, intends to take part in the election to call for economic reform and ending confrontation with Washington but said that officials have tried to discourage him from standing.

"I was in Tehran two weeks ago and they told me to stay away," he told Reuters from New Jersey, where he is a professor of planning and public policy at Rutgers University.

"They said that my safety is in danger. They are really nervous and that surprises me."

Traumatized moms avoid tough talks with kids

May 6, 2013 ? Mothers who have experienced childhood abuse, neglect or other traumatic experiences show an unwillingness to talk with their children about the child's emotional experiences, a new study from the University of Notre Dame shows.

According to the study, which was presented at the Society for Research in Child Development 2013 Biennial Meeting in Seattle, a sample of low-income mothers who had experienced their own childhood traumas exhibited ongoing "traumatic avoidance symptoms," which is characterized by an unwillingness to address thoughts, emotions, sensations or memories of those traumas. This avoidance interfered with mothers' ability to talk with their children about the child's emotions, leading to shorter, less in-depth conversations; those mothers also used closed-end questions that did not encourage child participation.

"Traumatic avoidance symptoms have been shown to have a negative impact on the cognitive and emotional development of children," said Kristin Valentino, Notre Dame assistant professor of psychology who specializes in the development of at-risk and maltreated children. Valentino conducted the research with Notre Dame undergraduate Taylor Thomas.

"This research is important because it identifies a mechanism through which we can understand how maternal trauma history relates to her ability to effectively interact with her child. This finding also has implications for intervention work, since avoidance that is used as a coping mechanism is likely to further impair psychological functioning," Valentino said.

In a related study published recently in the journal Child Abuse and Neglect, Valentino found that maltreating parents, many of whom had experienced childhood trauma, could successfully be taught to use more elaborative and emotion-rich reminiscing with their preschool-aged children, which has been linked to a children's subsequent cognitive abilities in a number of areas including memory, language and literacy development.

Family photos and family dinners are fond memories for the members of most families. But for Cassandra Williamsand Phillip Hamilton, those were just a fa?ade of their broken homes.

"At 15 years old, the extramarital affairs became evident, causing arguments between my parents," Hamilton told Outlook. Hamilton replayed the broken records of disagreements. His parents had reached their boiling point after the father's infidelity was revealed in the form of an outside child. They ended their relationship, but their residence remained the matrimonial room.

This exacerbated the confusion buried in the children's minds as Hamilton and his younger sister were faced with the reality of their living together but not actually being together. "Our house was no longer a happy home. Knowing about all the affairs, I witnessed first-hand our nuclear family falling apart."

He said it taught him to grow up very quickly. "I began boarding at school and, at age 18, after my mother succumbed to her battle with breast cancer and passed away, my father moved out of the family home and moved in with his new girlfriend and her children. My sister moved out after she reached 18. I believed she moved out early to get her own space." He continued, "It did not affect my academics, but my family life was scarred and was never the same. My mother's passing affected everyone, including my father, who was quite emotional after hearing the news."

But he notes, "l love my parents. I was always close to my mother, and I'm close to my father. My parents' relationship has taught me many things. I now have no intentions of marrying or settling down to start a family with a partner anytime soon, as I believed my parents rushed into getting married and their dependence on each other made them separate but remain living miserably under the same roof. Sometimes, it is hard to forgive and even harder to forget. I realise that two people can love each other, but they just cannot be together, because love is just not enough."

The cookie crumbles

Williams got the announcement that her parents were seperating when she was 17 years old. "My parents announced to the family that they would be going through a trial separation. This trial is still taking place, and I am now 25, so I guess it is safe to say that this trial is now a permanent one."

The cookies crumbled for her when it was revealed that her mother broke her wedding vows and was unfaithful to her father. "They lived in the same room, slept on the same bed, with one turning their head to the top of the bed and the other turning their head to the opposite end." It affected her psychologically, as what was once a fun-filled home became a lonely one. Her mother spent more time outside of the house, to avoid arguments, and her father had to live with the fact that his wife cheated on him, a fact, she said, that was not easy for him to come to grips with. "Arguments would often ensue, malevolence would follow, and you could just cut the tension in the house with a knife. I would just leave the house to avoid everything. She sought solace in other extra-curricular activities, which became a coping mechanism for her. "At first, I developed deep resentment for my mother for not only committing a heinous act, but also for being away all the time, and it drove us apart, affecting our relationship in the latter part of my adolescence." She said her parents stayed together for the sake of the children, "but sometimes I just wished they had divorced and gone their separate ways, because sometimes we were forced to choose sides, or the anger would be taken out on us. Quality family time was also spent separately, with only one parent present at a time."

She notes that, years after the separation, she began redeveloping a relationship with her mother. She currenlty has very different but close relationships with both prarents.

Counselling psychologist Howard Gough explained, "It is very hard to determine whether or not a couple has been separated if they are living under the same roof, or to make matters even more complicated, living in the same room and sharing the same bed."

But according to attorney-at-law Sherry-Ann McGregor, "Under Jamaican laws, couples no longer apply to the court for separation orders. They simply live apart (whether physically under the same roof or not) on the premise that the marriage has broken down irretrievably." She notes that, from a legal standpont, "Couples can separate while living in the same house or bedroom. In law, 'separation' does not mean living physically apart. It means that either spouse intends to bring the marriage to an end, and acts upon that intention by changing the way they relate to each other. It differs from one couple to another and may mean the end of sexual relations to one couple or a decision not to wash and cook for each other to another couple."

Gough notes that, "The arguing which ensued between the couples was the sign of an emotionally abusive relationship. This type of relationship displayed in front of the children could have impacted them in different ways. They would either internalise or externalise their situations. It could have made the children socially withdrawn, imploding to cause seclusion and depression, or seriously aggressive, which would result in becoming problematic or even violent."

Gough points out that it would have been better for the children if the couples had moved out of the house, as living together posed complications for all parties involved, not just the couples themselves, but their children as well.

Hamilton admits that, because of his parent's separation, he is not quick to commit, and what he went through might negatively affect his standings with a potential partner, as he may appear too cautious and intimately withdrawn.

McGregor notes that a divorce in Jamaica that costs approximately $60,000 does not have to be a messy ordeal. But she cautions, "Any rights to property either party to a marriage had prior to separation are not extinguished by a decision to leave or remain in the family home."

Israel airstrikes loom over US diplomacy on Syria

WASHINGTON (AP) ? Israel's willingness to hit Syrian targets it sees as threats to its own existence has complicated the Obama administration's internal debate over arming President Bashar Assad's foes and may change the way U.S. approaches allies as it tries to boost the rebels, including with possible military aid.

As Secretary of State John Kerry flew to Russia on Monday for talks with the Assad regime's most powerful ally, the administration remained tight-lipped on both Israel's weekend air strikes and their implications for Washington decision-making.

Israeli warplanes targeted caches of Iranian missiles that were bound for Hezbollah, the Lebanon-based terror group that has threatened Israel. The weapons would have allowed Hezbollah to strike Tel Aviv and as far as southern Israel from inside Lebanese territory.

Still, Israel's actions put Damascus and Moscow on notice that the U.S. and its allies may not wait for an international green light to become more actively engaged. The administration said last week it was rethinking its opposition to arming the rebels or taking other aggressive steps to turn the tide of the two-year-old civil war toward the rebels.

At the same time, Israeli involvement in the war carries risks. Instead of prodding Russia into calling for Assad's ouster, it could bring greater Arab sympathy for Assad and prompt deeper involvement from Iran and the Lebanese militant group Hezbollah, actors committed as much to preserving Assad as to fighting the Jewish state.

Although Israel hasn't officially acknowledged it carried out the airstrikes, Syrian officials on Monday were blaming Israel, calling it a "declaration of war" that would cause the Jewish state to "suffer."

Russia, alongside China, has blocked U.S.-led efforts three times at the United Nations to pressure Assad into stepping down. Officials said Kerry hopes to change Moscow's thinking with two new arguments: American threats to arm the Syrian rebels and evidence of chemical weapon attacks by the Assad regime.

Kerry, U.S. officials said Monday, hopes that may be enough to persuade Russian President Vladimir Putin to support, or at least not veto, a fresh effort to impose UN sanctions on Syria if Assad doesn't begin transition talks with the opposition. The officials demanded anonymity because they weren't authorized to speak publicly about the confidential diplomacy.

"We have consistently, in our conversations with the Russians and others, pointed clearly to Assad's behavior as proof that further support for the regime is not in the interest of the Syrian people or in the interest of the countries that have in the past supported Assad," White House spokesman Jay Carney said.

"We have been clear in the past about our disappointment with Russia over their opposition to resolutions at the Security Council with regards to this matter. But this is an ongoing conversation," he said.

U.S. officials said the administration doesn't believe the weekend activity will force President Barack Obama's hand, noting that the U.S.'s main concern is the use of chemical weapons by Assad, while Israel's top concern is conventional weapons falling into the hands of its enemies.

The chemical weapons argument is now under surprising attack, with former war crimes prosecutor Carla Del Ponte saying over the weekend she and fellow members of a four-member U.N. human rights panel have indications the nerve agent sarin was used by Syrian rebel forces, but not by government forces.

Despite a clarification from the UN that it is has not yet made any definitive determination on chemical weapons use, Washington pushed back on del Ponte's assertion, saying it's highly likely that the Assad regime, and not the rebels, has been behind any chemical weapons use in Syria.

"We are highly skeptical of suggestions that the opposition could have or did use chemical weapons," Carney said. "We find it highly likely that any chemical weapon use that has taken place in Syria was done by the Assad regime. And that remains our position."

The State Department said the administration continues to believe that Syria's large chemical weapons stockpiles remain securely in the regime's control.

The Obama administration opened the door to new military options in Syria after declaring last week it strongly believed the Assad regime used chemical weapons in two attacks in March. Two days after that announcement, Defense Secretary Chuck Hagel said arming the Syrian rebels was a policy consideration.

Before departing for Russia, Kerry visited the Pentagon for a lunch meeting with Hagel. Defense Department press secretary George Little said he expected Syria to be discussed.

Also Monday, the chairman of the Senate Foreign Relations Committee called for the US. to provide weapons to vetted Syrian rebels. Sen. Bob Menendez, D-N.J., introduced legislation that would allow for arms, military training and non-lethal aid to rebels that meet certain criteria on human rights and don't have links to terrorism.

Until now, U.S. efforts to bolster the rebels' fighting skills and gather intelligence on the groups operating inside Syria have been limited to small training camps in Jordan, according to two U.S. officials, who weren't authorized to speak about secret activities and demanded anonymity.

There are several options for escalation ranging from arming the rebels to targeted airstrikes and imposing no-fly zones. However, arming the rebels is the most likely escalation, officials said.

Officials said targeted strikes are likely to be considered only after uncontested proof emerges of chemical weapons use. And, even the most ardent advocates of U.S. intervention don't want American military boots on the ground while no-fly zones would demand intensive operations to neutralize Syria's Russian-supplied air defenses.

Although Israel seems to have thwarted those defenses with its weekend strikes, U.S. officials say that maintaining permanent no-fly zones will require far more support than specific actions like the airstrikes.

Magnesium may be as important to kids' bone health as calcium

May 5, 2013 ? Parents are advised to make sure their children drink milk and eat other calcium-rich foods to build strong bones. Soon, they also may be urged to make sure their kids eat salmon, almonds and other foods high in magnesium -- another nutrient that may play an important role in bone health, according to a study to be presented Sunday, May 5, at the Pediatric Academic Societies (PAS) annual meeting in Washington, DC.

"Lots of nutrients are key for children to have healthy bones. One of these appears to be magnesium," said lead author Steven A. Abrams MD, FAAP, professor of pediatrics at Baylor College of Medicine in Houston. "Calcium is important, but, except for those children and adolescents with very low intakes, may not be more important than magnesium."

While it is known that magnesium is important for bone health in adults, few studies have looked at whether magnesium intake and absorption are related to bone mineral content in young children. This study aimed to fill that gap.

Researchers recruited 63 healthy children ages 4 to 8 years old who were not taking any multivitamins or minerals to participate in the study. Children were hospitalized overnight twice so their calcium and magnesium levels could be measured.

Participants filled out food diaries prior to hospitalization. All foods and beverages served during their hospital stay contained the same amount of calcium and magnesium they consumed in a typical day based on the diaries. Foods and beverages were weighed before and after each meal to determine how much calcium and magnesium the subjects actually consumed. In addition, parents were given scales to weigh their child's food for three days at home after the first inpatient stay and for three days at home prior to the second inpatient stay so that dietary intake of calcium and magnesium could be calculated accurately.

While hospitalized, children's levels of calcium and magnesium were measured using a technique that involved giving them non-radioactive forms of magnesium and calcium, called stable isotopes, intravenously and orally. Urine was collected for 72 hours. By measuring the stable isotopes in the urine, the researchers could determine how much calcium and magnesium were absorbed into the body. Bone mineral content and density were measured using total body dual-energy X-ray absorptiometry.

Results showed that the amounts of magnesium consumed and absorbed were key predictors of how much bone children had. Dietary calcium intake, however, was not significantly associated with total bone mineral content or density.

"We believe it is important for children to have a balanced, healthy diet with good sources of minerals, including both calcium and magnesium," Dr. Abrams concluded.

Rookie's unusual week ends in win at Wells Fargo

CHARLOTTE, N.C. (AP) ? Derek Ernst didn't come out of nowhere to win the Wells Fargo Championship. He actually was driving a rental car toward Athens, Ga., the fourth alternate who figured he might as well spend the week playing in the minor leagues.

He wound up a playoff winner at Quail Hollow with a game that wins anywhere.

It's easy to get caught up in the elements that make his victory Sunday so amazing.

Ernst is a 22-year-old rookie who was finishing up at UNLV at this time a year ago. He was No. 1,207 in the world ranking, having played only eight PGA Tour events, one of them last year when he earned a spot through Monday qualifying. He had made only two cuts this year, which led to being the No. 4 alternate.

Players like Ernst don't typically get into a tournament like the Wells Fargo Championship. But there was so much talk about the shabby shape of the greens ? and they were worse than players were told ? that several players decided not to play.

Ernst got the phone call Monday that he was in at Quail Hollow, so he drove on to Athens to return his rental car ? a $1,000 drop-off fee sounded like a lot of money at the time ? and pick up another one and head to Charlotte.

The rest of the week went by so quickly. The opening round of 67. Staying in the mix over the next two days in cold weather. Overlooked on Sunday in the cold rain, mainly because of the names at the top of the leaderboard ? Phil Mickelson, Nick Watney, Rory McIlroy and Lee Westwood among them.

All of them had their issues on the back nine, none worse than Mickelson, who had a one-shot lead until bogeys on the 16th and 17th holes that cost him. Ernst not only played bogey-free on the back nine and shot 33, he saved his best for the final hole.

One shot behind David Lynn of England, who was in the same group, Ernst choked down on a 6-iron from 192 yards and hit a draw that dropped 4 feet from the cup for a birdie. It was one of only four birdies on the 18th hole in the final round, and this gave him a 2-under 70 and a spot in the playoff with Lynn, who also had a 70.

"I was trying to hit it as close as I possibly could," Ernst said.

Under the circumstances, his shot in the playoff was just as good, even if Ernst concedes to being a little lucky. Lynn was in trouble off the tee, on the bank of a creek with the ball well above his feet. Ernst hit a 3-iron that settled 15 feet left of the cup.

"I pulled it a little bit," he said with a grin.

No matter. Lynn was thinking of laying up and trying to make par from short of the green until he saw Ernst's shot. That forced him to take a hybrid, and he put that in the right bunker. His shot out of the wet sand sailed over the green and nearly went into the creek. By then, the tournament effectively was over. Lynn chipped on to 5 feet and never had to putt for bogey after Ernst's birdie putt caught the lip and he tapped in.

"This feeling is unbelievable right now," said Ernst, who wasn't sure where he was going at the start of the week and can't believe where he's going now.

For starters, the victory at Quail Hollow gets him into The Players Championship next week. He qualifies for two World Golf Championships, the PGA Championship, the Tournament of Champions next year at Kapalua and the Masters next April.

No need to get another rental car for the drive to Ponte Vedra Beach, Fla. Along with a two-year exemption on tour, Ernst won just over $1.2 million.

"I'm flying," he said.

Of the rookies on tour this year, Ernst probably got the least amount of attention. He grew up in the central valley of California, and he's lucky to be playing golf. As a young boy, he was building his mother a Valentine's Day present with his junior tool set when a piece of plastic pipe ricocheted toward his face and sliced into his right eye ball. He had to get 10 stitches, and still has blurred vision.

He's fidgety and thinks too far ahead instead of worrying about the next shot. He works with Susie Meyers, who helps him with course management and proper thinking. She also works with Michael Thompson, who won the Honda Classic.

But he's a winner now, and it's really no mystery.

"I've never heard of him," Lynn said. "He's a nice player. He said he was 180th on the FedEx Cup list when we were chatting on the way around. He played super. I mean, he could have won it quite easily in regular play. He played the finish really solid, and then he hit two really solid shots in the playoff. So every credit to him. Well done."

Not only did Ernst shoot 33 on the back nine, he missed a 5-foot birdie putt on the 14th hole after nearly driving the green, and a 6-foot birdie putt on the 16th. He also made a few tough par putts.

That's what Mickelson failed to do.

Closing in on a victory he wanted dearly at Quail Hollow, Mickelson took a one-shot lead with a tap-in birdie on the 14th, and he was poised to widen his lead on the par-5 15th. His second shot came up just short and into the bunker, but Mickelson could only blast that out to 12 feet and he left the birdie putt short. That proved costly.

His chip was too strong on the 16th and he missed the 6-foot par putt to fall into a three-way tie. At that point, Ernst and Lynn had finished at 8-under 280. Then, Mickelson three-putted from 65 feet just off the green, leaving the first putt about 8 feet short. He suddenly needed birdie on the 18th to join the playoff, and his 20-foot attempt narrowly missed.

"I'm pretty bummed out," Mickelson said. "I thought that this was one I had in control. If I could have gotten that bunker shot up-and-down on 15, I would have had a two-shot lead heading into those last three holes, which I know are difficult holes, so it would have been nice to have that.

"There is just no excuse," he said. "It wasn't easy, but it wasn't anything out of the ordinary or difficult. I should have made par."

Ernst became the seventh player this year to win for the first time on the PGA Tour.

I'm Too Old For This Week in Gaming Apps S**t - Kotaku

You kids get off of my lawn! Damn, that really does feel good. I turned 40 on Wednesday, so excuse me if I didn't play as many gaming apps this week as you young people did. These old eyes aren't what they used to be.

Okay, not an excuse. If anything I should be playing more apps, what with all the time sitting out on the back porch (we don't have a front porch), rocking back and forth in my chair and watching the weather. Or The Weather Channel app.

Hell, technically old men don't even have to go outside anymore. In a few years I'll be downloading an app that delivers the same experience as walking outside and sweeping the leaves out of the driveway every 15 minutes, without having to deal with any whippersnappers. Some would argue that app is already here several times over.

But it's none of this week's apps. These are spritely, virile games, filled with action and adventure and carefully considered strategy and wisdom ? all hallmarks of a newer generation, except for the second two.

Botox finds new wrinkle in brain communication

National Institutes of Health researchers used the popular anti-wrinkle agent Botox to discover a new and important role for a group of molecules that nerve cells use to quickly send messages. This novel role for the molecules, called SNARES, may be a missing piece that scientists have been searching for to fully understand how brain cells communicate under normal and disease conditions.

"The results were very surprising," said Ling-Gang Wu, Ph.D., a scientist at NIH's National Institute of Neurological Disorders and Stroke. "Like many scientists we thought SNAREs were only involved in fusion."

Every day almost 100 billion nerve cells throughout the body send thousands of messages through nearly 100 trillion communication points called synapses. Cell-to-cell communication at synapses controls thoughts, movements, and senses and could provide therapeutic targets for a number of neurological disorders, including epilepsy.

Nerve cells use chemicals, called neurotransmitters, to rapidly send messages at synapses. Like pellets inside shotgun shells, neurotransmitters are stored inside spherical membranes, called synaptic vesicles. Messages are sent when a carrier shell fuses with the nerve cell's own shell, called the plasma membrane, and releases the neurotransmitter "pellets" into the synapse.

SNAREs (soluble N-ethylmaleimide-sensitive factor attachment protein receptor) are three proteins known to be critical for fusion between carrier shells and nerve cell membranes during neurotransmitter release.

"Without SNAREs there is no synaptic transmission," said Dr. Wu.

Botulinum toxin, or Botox, disrupts SNAREs. In a study published in Cell Reports, Dr. Wu and his colleagues describe how they used Botox and similar toxins as tools to show that SNAREs may also be involved in retrieving message carrier shells from nerve cell membranes immediately after release.

To study this, the researchers used advanced electrical recording techniques to directly monitor in real time carrier shells being fused with and retrieved from nerve cell membranes while the cells sent messages at synapses. The experiments were performed on a unique synapse involved with hearing called the calyx of Held. As expected, treating the synapses with toxins reduced fusion. However Dr. Wu and his colleagues also noticed that the toxins reduced retrieval.

For at least a decade scientists have known that carrier shells have to be retrieved before more messages can be sent. Retrieval occurs in two modes: fast and slow. A different group of molecules are known to control the slow mode.

"Until now most scientists thought fusion and retrieval were two separate processes controlled by different sets of molecules", said Dr. Wu.

Nevertheless several studies suggested that one of the SNARE molecules could be involved with both modes.

In this study, Dr. Wu and his colleagues systematically tested this idea to fully understand retrieval. The results showed that all three SNARE proteins may be involved in both fast and slow retrieval.

"Our results suggest that SNAREs link fusion and retrieval," said Dr. Wu.

The results may have broad implications. SNAREs are commonly used by other cells throughout the body to release chemicals. For example, SNAREs help control the release of insulin from pancreas cells, making them a potential target for diabetes treatments. Recent studies suggest that SNAREs may be involved in neurological and psychiatric disorders, such as schizophrenia and spastic ataxia.

"We think SNARES work like this in most nerve cell synapses. This new role could change the way scientists think about how SNAREs are involved in neuronal communication and diseases," said Dr. Wu.

Federal investigators are searching various sites around Dartmouth, Mass., near where Boston Marathon bombing suspect Dzhokhar Tsarnaev went to college as authorities continue to look for evidence related to the attack.

Christina DiIorio-Sterling, a spokeswoman for the U.S. attorney?s office in Boston, confirmed the searches in an email amid local reports that law enforcement officials were spotted combing through a wooded area not far from the University of Massachusetts at Dartmouth, where Tsarnaev was a student.

?The searches at various locations in Dartmouth, Mass., today are part of the ongoing investigation into the marathon bombing,? she said. ?Residents should be advised that there is no threat to public safety.?

The Standard-Times newspaper in nearby New Bedford quoted a local man who spied dozens of local police and agents from the Bureau of Alcohol, Tobacco and Firearms searching a nature area with police dogs. A spokeswoman for the FBI?s Boston office confirmed that FBI agents also were involved in the search.

The search came as the New York Times and NBC News quoted unnamed federal officials who said Tsarnaev told authorities he and his brother Tamerlan, who was killed during a gunbattle with police on April 19, originally had planned to carry out their attack on July 4. But the bombings allegedly were moved up because the brothers completed building their explosives ahead of time.

Federal officials still are trying to figure out where the suspects built the arsenal of explosives, which included pressure cooker bombs and several pipe bombs.

On Wednesday, three college friends of Dzhokhar Tsarnaev?s were arrested and charged with obstruction of justice and lying to FBI agents. They allegedly admitted to removing a backpack and laptop from Tsarnaev?s dorm room at U-Mass after they realized he was one of the suspects in the marathon bombings, which killed three people and injured more than 200.

Federal agents recovered the backpack from a local landfill last week and found it contained several fireworks that had been opened and emptied of powder. Officials later said they also had recovered Tsarnaev?s laptop, though it was unclear where it was found.

Getting the Nexus 4 into customers' hands aside, the Google-LG team-up was a huge boost to the Korean manufacturer's smartphone fortunes. According to the Korea Times, LG's now looking to repeat the magic and is already working with Google on a Nexus sequel. Presumably another phone beyond that Optimus G sequel we've been promised, there's no word yet on whether we'll see any new Google-branded hardware at this year's I/O event. We reached out to an LG spokesperson, who told us that it doesn't comment on rumor and speculation, although the meeting wasn't all about the Nexus series. LG is also apparently looking for more cooperation with Google on TVs and other future hardware -- Glass was apparently mentioned in passing.

Lindsay Lohan appeared to have skipped out on a court-ordered rehab program on Thursday, before doing a disappearing act and possibly violating her probation again.

Although her lawyer assured a Los Angeles judge on Thursday that she had checked in to start a 90-day stint imposed for a June 2012 reckless driving case, Lohan was photographed about the same time shopping in a Southern California electronics superstore.

Santa Monica city prosecutor Terry White told the Los Angeles Times hours later that he had learned that Lohan, 26, spent only a few minutes at the rehabilitation facility in Newport Beach before leaving.

"Ms. Lohan is in violation of her probation. That much is clear," White told the newspaper.

Lohan is still on probation for a 2011 jewelry theft. Any violation could make her liable to arrest and being ordered to jail.

Calls to Lohan's lawyer and publicist were not returned on Thursday and celebrity news websites reported no further sightings of the troubled "Mean Girls" actress.

Lohan, 26, was sentenced to 90 days in a locked rehab center as part of a March plea deal. She avoided jail by pleading no contest to charges that she lied to police when she said she was not behind the wheel of a car that smashed into a truck in the beach city of Santa Monica in June 2012.

Lohan had until Thursday to start her treatment and had initially agreed to go to a rehab center in New York.

Her last-minute switch, reportedly because she could not smoke in the New York facility, left White fuming on Thursday because he said he had not had time to vet the Morningside Recovery Center.

Officials at the Department of Alcohol and Drug programs said the center was not licensed to provide the kind of 24-hour residential alcohol or drug detox program that Lohan was ordered to attend.

The center said in a statement that it operated sober living homes and certified outpatient services at a clinic and had "successfully treated thousands of patients through our program."

Its website shows pictures of sunsets on the beach, and offers clients group trips to Disneyland, sailing and kayaking.

Los Angeles Superior Court Judge James Dabney gave prosecutors a week to investigate the Morningside Recovery center.

Lohan has spent at least five stints in rehab in the past six years for unspecified issues.

ATLANTA (AP) ? Reese Witherspoon pleaded no contest and paid a $100 fine after berating a state trooper in Atlanta while her husband was given a sobriety test, an embarrassing exchange caught on a dashboard camera after the usually squeaky-clean Hollywood star had what she called "one too many" glasses of wine.

The video, which was first obtained by TMZ and publicly released by authorities Friday, shows Witherspoon asking the trooper, "Do you know my name?" and then adding, "You're about to find out who I am."

Witherspoon's exchange with the officer had already been outlined in a police report, but the video offered a rare glimpse at the actress unfiltered. Witherspoon, who has built a wholesome professional image, apologized shortly after her arrest, saying she was "deeply embarrassed."

Municipal Court of Atlanta Deputy Solicitor Ronda Graham said in a statement that Witherspoon entered the plea and paid the fine, resolving the case.

During an interview with "Good Morning America" on Thursday, Witherspoon said she panicked and said "all kinds of crazy things," including falsely claiming that she was pregnant at one point. She said during the interview that she had too much to drink before her arrest.

In the video, the 37-year-old argues with the trooper while he attempts to question her husband, Hollywood agent Jim Toth, on an Atlanta street during the pre-dawn hours of April 19.

Toth pleaded guilty to a misdemeanor charge of drunken driving, Graham said. He was fined $600 and ordered to perform 40 hours of community service and participate in a program for DUI offenders.

That is a "standard sentence for a first-time offender," Graham said.

In the video, Trooper First Class J. Pyland tells Witherspoon to stay in the couple's vehicle no fewer than five times. For her part, Witherspoon is equally determined to get out and engage him, even at one point feigning to be pregnant and saying she needed to use the bathroom.

When the trooper starts to arrest her, she lets loose. The 5-foot-1 Witherspoon turns to yell at him while being handcuffed and accuses the trooper of harassment, at one point prompting him to warn her, "You fight me, I promise you ..."

Witherspoon's husband mostly observes the exchange, but tries to calm her after the trooper's warning about resisting arrest.

The dash-com video shows the situation quickly escalating. In one video clip, the trooper appears to be examining Toth when Witherspoon, out of view, starts to get out of her vehicle.

"Ma'am, get back in that car," the trooper tells her.

She apologizes, and asks if she can say something. "No ma'am," he says, "get back in that car. I'm not going to repeat myself again."

Later, when Witherspoon continues to try to intervene, the trooper handcuffs her.

"You better not arrest me! Are you kidding me?" she asks.

"Nope," he responds.

She protests again, "I'm an American citizen!" The trooper leans toward her and says he told her to stay in the car.

She repeats "This is beyond!" She turns to yell at the trooper as he's handcuffing her and he raises his chin and warns her against resisting arrest.

As Witherspoon is taken out of view, she can be heard asking, "Do you know my name sir?" When he says he doesn't need to, she asks, "You don't need to know my name?" He says "Not quite yet," and she adds, "Oh really. OK, you're about to find out who I am."

The trooper responds, "That's fine. I'm not real worried about you, ma'am. I done told you how things worked. You want to get out and get up in my investigation, that's OK."

No one from the Georgia State Patrol leaked the video before its official release on Friday, agency spokesman Gordy Wright said. The only copy that had been made earlier was for the prosecutor, Wright said.

The star of hit movies such as "Walk The Line," ''Legally Blonde," ''Sweet Home Alabama" and "Election" said during her interview that "there are so many lessons learned."

"When a police officer tells you to stay in the car, you stay in the car," she said. "I learned that for sure. I learned a lot."

Know the regs that help avoid ACA free-rider penalties ? Business ...

The bottom line for you to avoid free-rider penalties under the Affordable Care Act (ACA) health care reform law is not to have employees obtain health insurance on the individual exchange and qualify for premium tax credits or other cost sharing reductions. Three sets of regulations steer you through this maze.

Qualifying for premium tax credits. Employees become eligible for premium tax credits and other cost sharing reductions when their group health plan doesn?t cover minimum essential benefits and their contributions for the lowest-cost plan for self-only coverage exceed 9.5% of their household income (even if they opt for family coverage).

Final regs, which become effective for tax years beginning after Dec. 31, 2013, offer penalty relief to employers by loosening two key requirements.

• Employees who actually enroll in employer-sponsored group coverage aren?t eligible for premium tax credits, even if the group coverage exceeds 9.5% of their household income or wasn?t minimum essential coverage.
• Employees who could have enrolled in group coverage, either through a regular open enroll??ment period or a special enrollment period, and who didn?t enroll, also aren?t eligible for a premium tax credit. (78 F.R. 7264, 2-1-13)

In addition, you won?t be liable for penalties if you use a safe harbor.

Safe harbor No. 1: Benefits are affordable if employees? contributions don?t exceed 9.5% of their W-2, Box 1 income.

Safe harbor No. 2: Benefits are affordable if employees? contributions don?t exceed 9.5% of their hourly rates of pay on the first day of the plan year, multiplied by 130.

Safe harbor No. 3: Benefits are affordable if employees? contributions don?t exceed 9.5% of the federal poverty line for an unmarried individual, divided by 12.

NO RETALIATION: Since free-rider penalties apply if even one employee buys insurance through the individual exchange and receives a premium tax credit or other cost sharing reduction, it may be tempting to lash out at him or her, or even not to hire someone whom you suspect would be eligible for a tax subsidy. Avoid that temptation.

Under an interim final rule, which became effective Feb. 27, 2013, employees or prospective employees who are fired, intimidated, threatened, coerced, blacklisted or disciplined because they obtained a tax subsidy may file retaliation complaints with OSHA. Should OSHA determine retaliation occurred, you could be ordered to reinstate employees and be on the hook for back pay, attorneys? fees, etc. (78 F.R. 13222, 2-27-13)

Contesting free-rider liability. Free-rider penalties will be collected by the IRS, and, as with all tax penalties, you will have a chance to contest your liability. But, in addition to the IRS appeals route, regs proposed by the Department of Health and Human Services would require exchanges to notify you if an employee qualifies for a tax credit and give you 90 days to respond to an exchange?s decision that an employee qualifies for a tax credit. Information you might need: To be successful, you?ll probably need to submit information on the company?s coverage options, whether the employee has taken up coverage, the employee?s income and the employee?s portion of the lowest cost plan for self-only coverage. These regs won?t become effective until final regs are issued. (78 F.R. 4593, 1-22-13)
